Terms & Conditions

1. Who you are contracting with

CartBook is operated by Posch Inc, DBA Moke America Virginia Beach ("CartBook", "we", "us"). These Terms & Conditions form a binding agreement between you and Posch Inc, DBA Moke America Virginia Beach covering your access to and use of the CartBook website, applications and valuation service (the "Service").

2. Acceptance

By creating an account, purchasing a trial or subscription, or otherwise continuing to use the Service, you agree to these Terms. If you are accepting on behalf of a company or dealership, you confirm you have authority to bind that organization. If you are accepting as an individual, you confirm you are of legal age to enter a contract. If you do not agree, do not use the Service.

3. The Service

CartBook provides estimated wholesale, retail and trade-in value ranges for used golf carts and low-speed vehicles, together with comparable listings, adjustment breakdowns, saved appraisals and printable reports. Values are guidance only. They are estimates generated from market data and the inputs you supply, and they are not a certified appraisal, an offer to buy or sell, a guarantee of resale value, or financial advice. You are responsible for your own buying, selling and pricing decisions.

4. Your account

You must provide accurate registration information and keep it current. You are responsible for keeping your credentials confidential and for all activity under your account. Seats are limited by plan: the Individual plan is for a single user, and the Business plan permits up to four named users within one organization. Credentials may not be shared beyond your plan's seat allowance.

5. Acceptable use

You must not:

• use the Service for any unlawful purpose, or in violation of any applicable law;
• engage in fraud, misrepresentation of valuations to third parties, or spam;
• infringe the intellectual property or privacy rights of others;
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning systems, circumventing rate limits or access controls, or scraping;
• reverse engineer, decompile, resell, sublicense or redistribute the Service or its data outputs as a competing valuation product;
• import or upload listing data you do not have the right to use, or data obtained in breach of a third-party marketplace's terms.

6. Your content and imported data

You retain ownership of the vehicle records, listings and appraisal data you enter or import. You grant us a limited, non-exclusive license to host, process and display that content solely to operate and improve the Service for you. You are responsible for having the rights to any content you import. If a rights holder notifies us of infringing material, we may remove it; repeated infringement may result in termination.

7. Intellectual property

Posch Inc, DBA Moke America Virginia Beach retains all right, title and interest in the Service, including its software, valuation models, methodology, data compilations, documentation, design and branding. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. No other rights are granted.

8. Payment, subscriptions and taxes

CartBook is offered as a one-time paid 5-day trial and as monthly or annual subscriptions. Subscriptions renew automatically at the then-current rate for the cycle you selected until cancelled. Plan changes take effect immediately, with upgrades charged prorated and downgrades credited to the next invoice.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, invoicing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our own refund commitment is set out in our Refund Policy.

9. Service availability

We work to keep CartBook available and accurate, but we do not guarantee uninterrupted or error-free performance. The Service may be unavailable for maintenance, updates, or circumstances outside our control, and market data sources may change or become unavailable.

10. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, consequential or special damages, including lost profits, lost data or loss of goodwill. Our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months before the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

11. Indemnity

You agree to indemnify Posch Inc, DBA Moke America Virginia Beach against claims arising from content you upload or import, your unlawful use of the Service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time; access continues until the end of the period you have already paid for. Following termination, you may request an export of your saved appraisals for 30 days, after which your data may be deleted.

13. Changes to these Terms

We may update these Terms to reflect changes to the Service or the law. Material changes will be notified by email or in-app before they take effect. Continued use after the effective date constitutes acceptance.

14. Assignment, force majeure and law

You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition or sale of assets. Neither party is liable for delay caused by events beyond its reasonable control. These Terms are governed by the laws of the Commonwealth of Virginia, United States, and the state and federal courts located in Virginia have exclusive jurisdiction over disputes.
